Cancellation Policy & Cancellation Form
Consumers are entitled to a right of withdrawal in accordance with the following provisions. A consumer is any natural person who enters into a legal transaction for purposes that are predominantly neither commercial nor self-employed professional in nature.
A. Cancellation Policy
Right of Withdrawal
You have the right to withdraw from this contract within 30 days without giving any reason.
The withdrawal period is 30 days from the day on which you or a third party designated by you, who is not the carrier, took possession of the last item.
To exercise your right of withdrawal, you must inform us (Heiko Schöller, Concretewave Skateshop, Subbelrather Strasse 140, 50823 Cologne, Germany, Tel.: +49 221 3974669, Email: info@concretewave.de) of your decision to withdraw from this contract by means of a clear statement (e.g. a letter sent by post or an email). You may use the attached model withdrawal form for this purpose, but it is not mandatory.
To meet the withdrawal deadline, it is sufficient for you to send your notification of exercising the right of withdrawal before the withdrawal period expires.
Consequences of Withdrawal
If you withdraw from this contract, we shall reimburse all payments we have received from you, including delivery costs (with the exception of additional costs resulting from your choice of a delivery method other than the least expensive standard delivery offered by us), without undue delay and no later than fourteen days from the day on which we receive notification of your withdrawal from this contract. For this reimbursement, we will use the same means of payment that you used for the original transaction, unless expressly agreed otherwise with you; in no case will you be charged any fees for this reimbursement. We may refuse reimbursement until we have received the goods back or until you have provided proof that you have returned the goods, whichever occurs first.
You must return or hand over the goods to us without undue delay and in any event no later than fourteen days from the day on which you inform us of the withdrawal from this contract. The deadline is met if you send the goods before the period of fourteen days has expired.
You bear the direct costs of returning the goods for orders with a goods value of up to EUR 40.00. For orders of EUR 40.00 or more, we will bear the costs of return shipment (please request a return label by email at info@concretewave.de; applies only to customers and orders from Germany).
You are only liable for any diminished value of the goods resulting from handling other than what is necessary to establish the nature, characteristics, and functioning of the goods.
Exclusion or Premature Expiry of the Right of Withdrawal
The right of withdrawal does not apply to contracts for the supply of goods that are not prefabricated and for which an individual selection or determination by the consumer is decisive, or which are clearly tailored to the personal needs of the consumer.
The right of withdrawal does not apply to contracts for the delivery of newspapers, periodicals, or magazines, with the exception of subscription contracts.
Linked / Financed Transactions
If you finance this contract with a loan and later withdraw from it, you are no longer bound by the loan agreement either, provided that both contracts constitute a single economic unit. This is particularly the case if we are also your lender or if your lender makes use of our cooperation with regard to financing. If the loan has already been paid to us when the withdrawal becomes effective or when the goods are returned, your lender shall assume our rights and obligations arising from the financed contract in relation to you with regard to the legal consequences of the withdrawal or return. This does not apply if the present contract concerns the acquisition of financial instruments (e.g. securities, foreign exchange, or derivatives). If you wish to avoid contractual obligations as far as possible, make use of your right of withdrawal and also withdraw from the loan agreement if you are entitled to a right of withdrawal in respect of it.
General Notes
Please avoid damaging or soiling the goods. Please return the goods to us in their original packaging with all accessories and all packaging components. If necessary, use protective outer packaging. If you no longer have the original packaging, please ensure adequate protection against transport damage by using suitable packaging.
Please do not return the goods to us postage unpaid.
Please note that points 1–2 above are not a prerequisite for the effective exercise of the right of withdrawal.
